I have gone back to v3.9 and everything is working perfectly.

This is not database error.
Part of code you reference to has not changed probably from osclass 3.0.
Tested publishing of new item and could not reproduce.
Tested with bender 3.2.0 and could not reproduce.
I've seen other errors you encounter as well, those I could never get, consider testing on solid hosting.

v3.9 works perfect.  No errors.  Same database and same server.

That does not explain or prove anything.
